Payment Method:
We accept VISA, MasterCard, Discover and American Express as well as Company Check, Registered Bank Certified Check and Wire Transfers. Purchase orders are accepted for corporate entities upon credit approval. Please contact finance@commxperts.com for a Corporate Terms and Conditions contract for credit approval. Additional charges may apply. Your credit card will be charged for product ordered, then shipped in a reasonable amount of time. Credit card orders shipped to locations other than your billing address may require additional verification or delay in shipment. Make business and registered certified checks payable to Communication Xperts. Include applicable sales, use or other tax and shipping and processing charges. Communication Xperts charges sales, use or other applicable taxes on shipments to applicable states. Communication Xperts also reserves the right to add applicable taxes on shipments to foreign countries, as well as billing “recipient’s taxes and duties” upon customs clearance and acceptance of delivery.

Prices and Availability:
Because of the fast-moving nature of the industry, prices and availability are subject to change without notice. Communication Xperts is unable to issue price adjustments due to manufacturer price changes after date of original sale. Your Communication Xperts Account Executive will inform you when a product is not in stock and can tell you when we expect the product will be available. Anticipated delivery dates are based upon vendor supplied information and are subject to change.

Shipping, Handling and Processing Charges:
We ship by FedEx® for U.S. Territories, Canada and other International locations. For APO and FPO addresses, we use U.S. Mail. Extra shipping and processing charges apply for Alaska and Hawaii, and may take additional days to process. Shipping and processing charges are based on average/estimated weights and may vary from actual shipped weight. Call for detailed shipping and processing charges. The shipping, handling and processing charges are designed to compensate our company for services we provide that enable our customers the convenience of ordering from us and receiving delivery of our products, including but not limited to handling and processing your order, packing and shipping your purchase, and providing you customer service and support, as well as overhead costs associated with these services. Same day shipping: Web orders placed and credit approved by 4:00 p.m. (EST) weekdays for items in stock not requiring configuration for delivery to the contiguous U.S. will ordinarily ship that same day via FedEx 2Day Express. FedEx 2Day provides delivery by 5:00 p.m. the second business day in areas where available. Web orders placed and credit approved by 12:00 p.m. (EST) on Saturday for items in stock not requiring configuration for delivery to the contiguous U.S. could possibly ship that same day via FedEx 2Day service. Delivery expected for Tuesday delivery. FedEx Standard Overnight provides delivery by 4:30 p.m. the next day and is available for an additional charge. Because we cannot guarantee availability, please call us to confirm when the product is expected to ship. Call 1-877-4COMMXP for further information. For all orders where no shipping commitment is made, we expect to ship within 30 days of the order date. Shipping, Handling and processing charges may vary. Return Policy:
Communication Xperts prides itself on a tradition of outstanding customer care and support. Our devoted team of account representatives understands that our customers are the hallmark of our enduring partnerships. It is important for our customers to understand the standards that have been established within our industry regarding the terms and conditions of a sale. The purchases of wireless phones, accessories, software, and other consumer electronics are subject to manufacturer restrictions which may be different from other product purchases you transact. Most of the products sold by Communication Xperts are subject to a manufacturer’s warranty. The warranty provided by the manufacturer is the first place to look for assistance with difficulties that may accompany your purchase. Original shipping charges are not refundable.

Mobile Applications – Third Party Software Products: Software products are non-returnable: Wireless Phone manufacturers provide a one year warranty on all new equipment. Disclaimer: Downloading certain 3rd party applications may and can void your manufacturer’s warranty. Communication Xperts will make every attempt to support you with the software load, but will not be held responsible for damage or loss of the wireless product. Please contact your sales representative for further guidance.
Custom Configurations: No returns or refunds will be made for items that are special ordered for you or for unusual custom configurations of handsets or scanners.

Software Installations:
The customer gives Communication Xperts permission to accept all software licenses on their behalf for any custom software installation process. There may be an additional charge for pre-loading 3rd party applications on any consumer electronic device.

Software:
Installed (Mobile Application – Third Party Software Products) software is not returnable.
All licensing sales are final.

Defective Software:
Defective software will be directed to the 3rd party developer for support or returns. Original shipping charges are not refundable. Shipping charges on returned software are the responsibility of the customer.

Damaged Shipments:
If your shipment arrives damaged: You must note the damage on the carrier’s delivery record in accordance with the carrier’s policy, save the merchandise in the original box and packing it arrived in, and notify Communication Xperts immediately to arrange for a carrier inspection and pick up of damaged merchandise. If you do not notify Communication Xperts of damaged goods within the first 7 days of arrival, the regular return policy will override any claim of damage, and your purchase(s) will fall under all current manufacturer restrictions.

Defective/Dead on Arrival (DOA) Non-Software Products: If your shipment arrives DOA, you must notify Communication within 3 days of arrival, the regular return policy will override any claim of damage, and your purchase(s) will fall under all current manufacturer restrictions.

The return must be 100% complete, in original and resalable condition, with all original packaging, manuals, registration card(s) and software. Original shipping charges are not refundable. Shipping charges on returned products are the responsibility of the customer. Communication Xperts will match the shipping method and pay for shipping charges on replacement or exchange products. All late, non-defective, and/or incomplete returns are subject to a minimum 15% restocking fee.

How to Return Products:
Obtaining an RA number: Please contact your account executive within 14 days of purchase for a Return Authorization (RA) number before returning your product to Communication Xperts. No returns of any type will be accepted without an RA number. For faster service, please have the following information on hand when emailing for an RA number: customer name, order number, item number, serial number and the reason for the return. Requirements qualifying product for Communication Xperts credit
:
Product must have been purchased from Communication Xperts or www.commxperts.com website.

Product must be complete with accessories and packaging material and in original manufacturer’s box, and NO exterior markings on the unit.

Signed copy of the RA form and a Communication Xperts Return Authorization number must accompany shipment to Communication Xperts.

Copy of Proof of Purchase (POP) to consumer must accompany shipment to Communication Xperts.

Customer is responsible for freight charges (must be insured) when shipping product to Communication Xperts for return.
Any items received that are not covered by original RA will be returned at sender's expense.

Shipping Charges:
Original shipping charges are not refundable. Shipping charges on returned products are the responsibility of the customer. Communication Xperts will match the shipping method and pay for shipping charges on replacement or exchange products. We strongly recommend you fully insure your return shipment in case of loss or damage. All refused orders will be subject to a restocking fee. Shipping charges are not refundable. In addition, refused orders may be subject to additional shipping charges to cover the cost of returning the products to Communication Xperts. A minimum restocking fee of 15% may be applied to products returned as defective that test to be operational upon return. Additionally, any return that has missing accessories or is incomplete in packaging will be subject to the minimum 15% restocking fee.

Typographical, Photographical and Technical Errors:
Although we do our best to achieve 100% accuracy, occasionally errors and inaccuracies do occur. Should you encounter an error or inaccuracy, please inform us so it can be corrected. Products and packaging depicted may differ from stock available at the time of shipment. We reserve the right to substitute equivalent items. If an error is made and a product is listed at an erroneous price, Communication Xperts may, at its discretion, refuse or cancel any orders placed at the incorrect price. If an order has been confirmed and charged to your credit card at the incorrect price, Communication Xperts shall have the right to immediately issue a credit in the amount of the incorrect price.

Warranty Disclaimer and Limitations: Communication Xperts LLC passes through to its customers all manufacturers’ warranties and guarantees that are provided for the products it sells which may be passed through to its customers. Communication Xperts LLC makes no additional or independent warranties. To the full extent permissible by applicable law, Communication Xperts LLC disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. Communication Xperts LLC shall under no circumstances be liable for special, incidental, consequential (including lost profits or opportunities) or punitive damages, even if it has been advised of the possibility of such damages. The maximum liability of Communication Xperts LLC for all damages shall be limited to an amount not to exceed the purchase price of the product. Likewise, Communication Xperts LLC will not be liable for any damages of any kind arising from the use of its Web site, including, but not limited to direct, indirect, incidental, punitive and consequential damages. All merchandise is sold “as is”. Please check manufacturer packaging and materials for compatibility. Communication Xperts LLC makes no warranty as to the performance of any merchandise sold. We are not responsible for network outages, system downtime, lost data, etc. This disclaimer by Communication Xperts LLC in no way affects the terms of any applicable manufacturers’ warranties or guarantees. Communication Xperts LLC will provide copies of such warranties and guarantees upon request emailing returns@commxperts.com Certain state laws do not allow limitations on implied warranties or the exclusion or limitations of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you might additional rights and remedies that vary from state to state.

Disputes: You agree that any claims against Communication Xperts LLC relating in any way to your purchases from Communication Xperts LLC shall be submitted to confidential arbitration solely in Orlando, Florida, and you agree and submit to such jurisdiction and venue as exclusive and proper. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving and other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In any such arbitration, the parties shall be responsible for their own costs, expenses and attorney’s fees. In the event that this arbitration provision is unenforceable, you further agree any litigation regarding this agreement or any transaction shall be brought in the state or federal courts located within “the Middle District of Florida, Orlando Division, United States of America. You hereby agree and submit to such jurisdiction and venue as exclusive and proper.

Governing Law:
This transaction shall be governed by and interpreted in accordance with the laws of the State of Florida, United States of America; provided, however, that any and all disputes hereunder shall be decided exclusively by litigation in state or federal courts located within “the Middle District of Florida, Orlando Division, United States of America.

Transactions between you and Communication Xperts, and any disputes arising between you and Communication Xperts, including but not limited to claims relating to the content of our catalogs and Web site, shall be governed by and constructed in accordance with the laws of “the Middle District of Florida, Orlando Division, without regard to the laws regarding conflicts of law. If any provision of this agreement and shall unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Title-Risk of loss:
Title to items being purchased passes from Communication Xperts to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. Communication Xperts will not incur any forwarding costs on shipments. Communication Xperts shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo or other acts or events outside the reasonable control of Communication Xperts.

Third Party Service Contracts:
Communication Xperts is a reseller of various service contracts issued by and performed by third party service providers. We are not the providers of the services described in those contracts and the third party service provider is the only party responsible for performing, or arranging for performance, of those services. You agree that the third party service provider is solely responsible for fulfillment of the service obligations and you agree that you will look only to the third party service provider for any loss, claims, or damages arising from or related to the purchase and performance of those services. You also agree to release Communication Xperts from any and all claims arising from or related to the purchase and performance of the service to be provided by the third party service providers. In some states, those services may be subject to sales tax. To the extent that such taxes are collected by Communication Xperts, they are solely on behalf of the issuer of the service contract in Communication Xperts’ capacity as an independent sales agent for the service provider.

Additional Information:
Communication Xperts policies are subject to change without notice. We do our best to ship all orders as rapidly and accurately as possible. However, Communication Xperts is not liable for late or delayed shipments or system failures. Title to items being purchased passes from Communication Xperts to purchaser at the time of shipping. If you purchase items for export, you must obtain from the Federal government certain export documentation. Specific Commercial Invoice will be provided by shipping carrier, and provided for customs clearance. Terms of Communication Xperts’ agreements with certain vendors on the web forbid us from exporting certain product. Some products are not available for sale to schools. All trademarks and registered trademarks are used to benefit of their respective owners.

Right of Offset: At any time what an amount is due Communication Xperts, Communication Xperts shall have the right, without prior notice, to set off and apply any amounts otherwise owed by Communication Xperts to you, to any amounts owed to Communication Xperts by you, in all cases.
